New Tobacco Licensing Scheme Now in Effect – What You Need to Know

From 1 July 2025, all NSW service stations that sell tobacco or non-tobacco smoking products must hold a valid tobacco licence. This new licensing scheme replaces the old Retailer Identification Number (RIN) system and introduces stricter compliance, reporting, and enforcement measures.

What’s Changing?

If your business sells tobacco (including from vending machines) or any non-tobacco smoking product, you must apply for a licence through your MyServiceNSW account. A separate licence is required for each location where sales occur, including both physical stores and online platforms.

⚠️ Vaping products are only legally sold through pharmacies for therapeutic use. Retail sale by service stations or convenience stores is strictly prohibited, with significant penalties for non-compliance.

Important Deadlines

  • Apply by 1 October 2025 to continue selling products while your application is assessed.
  • From 2 October 2025, businesses without a valid application submitted must cease all sales or risk severe fines.
  • Fees: $1,100 per licence, renewed annually.

What You’ll Need to Apply

  • Proof of identity
  • National police check (obtained within the last 3 months)
  • Credit card for payment
  • Details of each business premises

Applications typically take 20 minutes online, but police checks can take several weeks, so we recommend applying early.

Penalties for Non-Compliance

  • Up to $11,000 (individual) or $220,000 (corporation) for trading without a licence
  • Higher fines for repeat offences or other breaches
