Mary Valley Servo Faces Shutdown, Hefty Fines Amid Planning Row with Council

A Service Station in Mary Valley might be shut down and could face fines exceeding $3 million from the Gympie Regional Council due to complaints regarding the changes made by its new owners.

Imbil’s Liberty service station, under new ownership, is contending with the Gympie Regional Council over purported violations of planning regulations related to the redevelopment of their mechanic’s garage.

Following council investigations in early August 2023, Bryan Properties has submitted a request to the council for retroactive approval for the extensive refurbishment of the shop on Imbil Island Rd.

Bryan Properties acquired the property in March 2023 for $1.23 million, as indicated by CoreLogic RP Data.

The renovations by the new owners include upgrading the three fuel pumps, renewing the front canopy, and installing a new fuel price display.

A council notice from August 18, 2023, included in the application, reveals a complaint triggered the investigation.

The inspection uncovered several suspected breaches of planning laws, including significant modifications to the garage, adding a large diesel tank, and constructing a new canopy and price display.

Another complaint was received on August 11 regarding the canopy, which was being stored on-site during the council’s inspection.

According to the council, the property’s existing use rights were not sufficient for its transformation from a workshop to a service station, leading to a notable increase in business.

The owners have been directed to either cease operating the building as a service station within 30 days or collaborate with the council for the necessary development approvals.

The notice warns that proven breaches could result in fines of up to $696,600 for individuals and $3.4 million for corporations.

The owners’ submission includes a report stating that fuel sales at the site have a history of over 30 years, possibly dating back to 1949. The previous owner, who has managed the business since 1989, highlighted fuel sales as a central aspect of the business, along with the car mechanic workshop.

The report also argues for the necessity of the service station in Imbil, as the nearest alternatives are 15 km and 20 km away.
